How to Sell Guns Legally in Maine
Complete Guide to selling a gun in Maine
The following information is for Maine residents that wish to sell firearms privately or to a dealer. Whether the guns are your own or something you inherited. One gun or an Estate Collection of guns.
Private Sales (not publicly advertised):
For private gun sales that are not publicly advertised, you are responsible for ensuring the buyer is not prohibited from owning a firearm under state and federal law.
- Verify the buyer's eligibility.
Maine Resident Gun Sales: A person may transfer a firearm to an unlicensed resident of their state, provided the transferor does not know or have reasonable cause to believe the transferee is prohibited from receiving or possessing firearms under federal law. The buyer must be a Maine resident and be legally allowed to own a firearm.
- Under federal law, you cannot sell a handgun to anyone under 18.
- Use a bill of sale. While not legally required, a firearm bill of sale is a good practice to document the transaction and protect yourself from future liability. You should include:
- Full names and addresses of both the buyer and seller.
- The firearm's make, model, and serial number.
- A statement that the buyer is legally permitted to own a firearm.
- A photocopy of the buyer's ID to verify their identity and residency.
Meet in a public place. To ensure safety for both parties, you should conduct the transaction in a public place. Do not have someone come to your house or the estate property. Beware someone not legally able to own a guns may use another person to buy their gun while they sit in the vehicle or another vehicle. Remember the gun is registered to you or the estate (if a relative passed away) and can be traced back to you if it is used in a crime. This is called a STRAW PURCHASE if purchased from a dealer.
FFL Transfer: You can still go to a dealer if you wish to have the firearm transferred to the new owner. A background check will be conducted on the buyer at the time of transfer.

Non Maine Resident Gun Sales:

The firearm must be legal in the state in which the buyer resides. Generally, for a person to lawfully transfer a firearm to an unlicensed person who resides out of state, the firearm must be shipped to a federal firearms licensee (FFL) within the transferee’s state of residence. The transferee may then receive the firearm from the FFL upon completion of an ATF Form 4473 and a NICS background check.
Advertised Private Sales and Gun Show Sales:

LD. 2224 An Act to Strengthen Public Safety by Improving Maine's Firearm Laws and Mental Health System:

This will require background checks on ALL advertised firearms sales (such as Uncle Henry's or other online or newspaper ads). LD 2224 will be in effect soon! It will be a Class C the crime of intentionally, knowingly or recklessly selling or transferring a firearm to a person who is prohibited from owning, possessing or having under that person's control a firearm. Establishes a Class C crime for a seller who is not a federally licensed firearms dealer to complete a transaction unless the seller facilitates the transaction through a federally licensed firearms dealer and the dealer performs a background check of the seller by using the Federal Bureau of Investigation, National Instant Criminal Background Check System. This legislation takes effect August 9th 2024.
For sales that result from an online ad, posting, newspaper listing, or occur at a gun show, you must facilitate the transaction through a Federal Firearms License (FFL) dealer.
- Involve a dealer. The buyer and seller must meet at an FFL dealer to complete the transaction.
- Buyer undergoes background check. The FFL dealer will run a background check on the buyer through the FBI's National Instant Criminal Background Check System (NICS).
- Dealer records the sale. The dealer must comply with all state and federal record-keeping requirements, as if they were the seller.
- Potential waiting period. A federal judge issued an injunction in February 2025 blocking Maine's 72-hour waiting period law for firearm purchases, but this is subject to ongoing legal challenges.
Out-of-state sales:
Federal law prohibits selling a firearm directly to a resident of another state.
